These terms explain the basis on which you may use our website and the general terms on which we do business. We have tried to keep them clear and fair. If anything is unclear, please ask us.
Younes Group is a trading name of Younes Estates Ltd, a company registered in England and Wales (company number 17535539) whose registered office is at 4th Floor, Flat 3, 182 to 184 Edgware Road, London W2 2DS.
Part A. Website terms of use
1. Who we are
This website, www.younesgroup.com, is operated by Younes Group. You can contact us by email at Show email address or by telephone on +44 7411 555 851.
2. Accepting these terms
By using this website you accept these terms of use. If you do not accept them, please do not use the website. We may update these terms from time to time, and the version shown here applies whenever you visit. These terms of use apply to the website only; our services are governed by the documents described in Part B.
3. Using the website lawfully
You may use this website for your own personal or business purposes in connection with finding, selling, letting or caring for a home. You must not:
- use the website in any way that breaks the law or is fraudulent;
- copy, scrape or extract property information, images or other content in bulk, whether by automated means or otherwise;
- try to gain unauthorised access to the website, the server on which it is hosted, or any connected system; or
- send us any material that is unlawful, offensive or harmful, or that contains viruses or other harmful code.
4. Property information and particulars
We take great care to describe every home accurately and to give you the information you need to make an informed decision. Please bear in mind the following.
- Property particulars, descriptions, photographs and video are provided for general guidance only. They do not form part of any offer or contract.
- Measurements, areas and floor plans are approximate and are provided to help you understand the layout. They should not be relied upon, for example to order carpets or furniture or to value a home.
- We provide material information, such as the price or rent, tenure, council tax band and any known restrictions or risks, in good faith from the information available to us. We do not verify every detail independently, and we have not tested the services, fittings or appliances.
- Buyers should rely on their own surveyors and solicitors, and tenants on the tenancy agreement and the documents provided before it is signed, to confirm anything that matters to them.
- Where a home is advertised to let, the rent shown is a specific amount. Where the letting would create an assured tenancy, we will not invite, encourage or accept an offer of a higher rent, as the Renters' Rights Act 2025 requires.
- Homes may be sold, let or withdrawn at any time, and the information shown may change. A home appearing on the website does not mean that it is still available.
If you notice anything on the website that you believe is inaccurate, please let us know so that we can correct it.
5. No offer or contract
Nothing on this website is an offer capable of acceptance. Making an enquiry, booking a viewing or submitting an offer through the website does not create a contract with us, with a seller or with a landlord. A sale becomes binding only when contracts are exchanged between the parties' solicitors. A letting becomes binding only when the landlord and the tenant have entered into a tenancy agreement. Our own services begin only once they have been confirmed in writing, as explained in Part B.
6. Intellectual property
We, or the people who have licensed material to us, own the copyright and other intellectual property rights in this website and its content, including text, photographs, floor plans, designs and the Younes Group name and logo. You may view and print pages for your own use. You must not reproduce, publish or adapt any content for commercial purposes without our written permission.
7. Links to other websites
Where this website links to other websites, such as property portals or the websites of regulators, those links are provided for your convenience only. We have no control over the content of those websites and are not responsible for them, or for any loss that may arise from your use of them.
8. Our liability for the website
We provide this website free of charge. While we work hard to keep it accurate and available, we do not promise that it will always be available, uninterrupted or free from errors.
If you are a consumer, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or of our failing to use reasonable care and skill. We are not responsible for loss or damage that was not foreseeable. We provide the website for domestic and private use, and we are not liable to you for any loss of profit, loss of business or business interruption.
If you are using the website in the course of a business, we exclude, to the fullest extent permitted by law, all implied conditions, warranties and representations, and we will not be liable for any loss of profit, sales, business or revenue, or for any indirect or consequential loss, arising from your use of the website or your reliance on its content.
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited or excluded by law.
9. Viruses and security
We take reasonable steps to keep this website secure, but we cannot guarantee that it will be free from bugs or viruses. You are responsible for protecting your own devices and for using appropriate security software.
Please be alert to fraud. We will never tell you about a change to our bank details by email alone. Before you send us money, please confirm our bank details by telephone, using a number you already hold for us.
10. Privacy
We use any personal data you give us in accordance with our Privacy Policy. Our Cookie Policy explains our use of cookies.
Part B. General terms of business
11. Your engagement letter or agency agreement
Before we act for you, we will always confirm in writing what we will do, what it will cost and when our fees become payable. This is set out in an engagement letter or agency agreement, which we will ask you to sign. These general terms apply alongside that document. If there is any conflict between them, your engagement letter or agency agreement prevails.
We will give you this information before you are committed to anything. Where you instruct us to sell a home, or to find a home for you to buy, this is a requirement of the Estate Agents Act 1979, and we follow the same practice in all our work.
If you lease your home to us under a guaranteed rent agreement, we are your tenant rather than your agent. The lease sets out the rent, the term and the responsibilities of each of us, and it governs our relationship in place of these general terms of business. Part A of these terms continues to apply to your use of the website.
12. Our fees
Our fees are published on our Fees page and are agreed with you in writing before we begin. All fees are stated inclusive of any VAT. Where a fee cannot reasonably be worked out in advance, for example a fee expressed as a percentage of the rent or the sale price, we explain how it will be calculated and give worked examples on request.
When we act for a landlord, we do not charge tenants any fee or payment that the Tenant Fees Act 2019 prohibits.
13. Client money
Any money we hold on behalf of clients or customers, such as rent, deposits and money held to pay for works, is kept in a designated client bank account, separate from our own money.
Interest earned on client money, if any, is dealt with as set out in your agency agreement.
14. Your right to cancel
If you are a consumer and you sign your agreement with us away from our business premises, for example at your home, or at a distance, for example by email or online, you have the right to cancel within 14 days without giving any reason. The cancellation period ends 14 days after the day on which the agreement is made.
To cancel, please tell us clearly in writing, for example by email to Show email address, before the 14 days have passed. We will also give you a cancellation form with your agreement, which you may use but do not have to.
We will not begin work during the cancellation period unless you expressly ask us to, in writing. If you ask us to begin and then cancel, you will pay for the services provided up to the time you tell us you are cancelling, in proportion to the full service you have agreed. If, at your request, we have fully performed the service before the cancellation period ends, you will lose your right to cancel. We will ask you to confirm that you understand this before we start.
If you cancel, we will refund any payment you have made, less any amount due for services already provided, within 14 days of your telling us that you are cancelling.
15. Identity and money laundering checks
The law requires us to verify the identity of our clients and, in many cases, of the other parties to a transaction, the people who own or control companies and trusts, and the source of the money involved. We will ask you for documents and information for this purpose, and we may use electronic verification and screening services.
We may decline to act, or stop acting, if we cannot complete these checks to our satisfaction, or if we have concerns about a transaction. The law may prevent us from telling you why. We are not liable for any delay or loss that results from our meeting these legal obligations. We have a legal duty to report any suspicion of money laundering or terrorist financing to the National Crime Agency.
16. Conflicts of interest and personal interest
We will not act where there is a conflict between your interests and our own, or between your interests and those of another client, unless we have told you about it in writing and you are content for us to continue.
If we, any of our staff, or anyone connected with us has, or is seeking, a personal interest in a home, we will tell you promptly and in writing. In sales and purchases this is a requirement of the Estate Agents Act 1979, and we follow the same practice in lettings. When we act for a seller, we will tell the seller promptly and in writing if a buyer has asked us for, or been offered, any service by us or by anyone connected with us.
We will pass every offer we receive to you promptly and in writing, unless you have told us in writing that you do not wish to receive offers of a particular kind.
We will not act for both the seller and a buyer, or for both the landlord and a tenant, in relation to the same home.
17. Referral arrangements
From time to time we may recommend other businesses, such as solicitors, mortgage brokers, insurers, removal firms or surveyors. If we receive a fee, commission or other benefit for a recommendation, we will tell you what it is, in writing, before you decide whether to use that business. You are always free to choose another provider.
18. Confidentiality and discretion
We understand that many of our clients value their privacy. We keep confidential all information about your affairs and your home, and we disclose it only where needed to provide our services, where you agree, or where the law requires or permits us to do so. We will not name you or your home in our marketing, or publish photographs of your home, without your consent.
19. Keys and access to homes
Keys, codes and access devices that we hold are coded so that the address cannot be identified from them, and are kept securely. We keep a record of each time a key is issued and returned, and of who has it.
We will release keys, or give access to a home, only with your signed authority, or as set out in your agreement with us, or in a genuine emergency. Where a home is occupied by a tenant, we will give the tenant proper notice of any visit, except in a genuine emergency.
20. Contractors we instruct for maintenance
When we arrange maintenance, repairs or other works at your home, we do so on your behalf and as your agent. Your contract for the work is with the contractor.
- We use contractors we consider competent and suitably insured, and who hold the qualifications that the law requires for the work, such as Gas Safe registration.
- Works costing more than the limit set in your agreement with us need your approval before they are instructed.
- In an emergency, where there is a risk to people's health or safety, a risk of serious damage to the home or a neighbouring property, or a legal requirement that must be met urgently, we may instruct essential works above the agreed limit without your prior approval. We will tell you as soon as we reasonably can.
- We will pass on any guarantees and warranties to you. We are not responsible for a contractor's work, but if something goes wrong we will help you to pursue it.
- If we supervise a larger project for a fee, we will agree the scope and the fee with you in writing beforehand.
21. Insurance
We hold professional indemnity insurance appropriate to our business. Owners and landlords remain responsible for insuring their home, its contents and their liability to others, and for telling their insurers that the home is let or empty where that is relevant. We are happy to help you arrange suitable cover.
22. Our liability to you
We will provide our services with reasonable care and skill.
Nothing in these terms, or in any agreement with us, limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited or excluded by law.
Subject to that, we are not responsible for any loss that was not reasonably foreseeable when our agreement was made, or for any loss caused by the acts or omissions of tenants, buyers, sellers, contractors or other third parties, except where it results from our own failure to take reasonable care.
If you are acting in the course of a business, our total liability to you arising from our services will not exceed the amount set out in your agreement with us, and we will not be liable for any loss of profit, revenue or business, or for any indirect or consequential loss.
If you are a consumer, nothing in these terms affects your statutory rights, including your rights under the Consumer Rights Act 2015.
23. Complaints and redress
If you are unhappy with any part of our service, please let us know. Our Complaints Procedure explains how we will deal with your complaint and how long it will take. It also explains how you can take a complaint further if we are unable to resolve it.
24. Events outside our control
We will not be responsible for any delay or failure to perform our obligations that is caused by events outside our reasonable control, such as extreme weather, fire, flood, epidemic, a failure of utilities or public services, industrial action or government restrictions. If such an event occurs, we will tell you as soon as possible and do what we reasonably can to reduce its effect.
25. General
If any part of these terms is found to be unenforceable, the rest will remain in effect. If we do not enforce any of our rights at once, we may still do so later. Nobody other than you and us has any right to enforce these terms, except as expressly stated in your agreement with us.
26. Governing law and courts
These terms, and any dispute arising from them, are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you are a consumer living in Scotland, you may bring proceedings in Scotland, and if you are a consumer living in Northern Ireland, you may bring proceedings in Northern Ireland.
